CA Notice at Collection

Under the California Consumer Privacy Act (CCPA) and other applicable state privacy laws, we are required to provide the following notice to California residents to inform them about how we collect, use, and share their personal information. The terms "Personal Information" (PI) and "Sensitive Personal Information" (SPI) have the meanings as defined by applicable state privacy laws. 1. Personal Information We Collect and Disclose

In the 12 months preceding the effective date of this policy, we have collected the following categories of Personal Information (PI) and Sensitive Personal Information (SPI), and we have used them for the purposes described in our Privacy Policy. Below are the categories of PI and SPI we may collect from consumers and the categories of third parties to whom this information may have been disclosed for business purposes in the past 12 months:

Please Note: Touchs Mail does not control the content of its users' emails. Emails may contain any type of information, including any category of personal information listed in state privacy laws.

2. Sales and Sharing

In the 12 months preceding the effective date of this policy, we have “sold” or “shared” certain types of Personal Information (such as IP addresses and internet activity data) for targeted advertising purposes (as defined by applicable state law). This information was shared with third-party advertising and analytics providers. To the best of our knowledge, we have not “sold” or “shared” the personal information of individuals under 16 years of age for targeted advertising purposes in the past 12 months.

Right to Opt-Out of Sales and Sharing

Depending on your state of residence, you have the right to direct us not to “sell” or “share” certain personal information for targeted advertising purposes. You can exercise this right by clicking on the "Your Privacy Choices" icon or [clicking here].

3. Your Rights

Depending on your state of residence, you may have the following rights, subject to applicable exceptions:

• The Right to Know: You have the right to request the categories of Personal Information we have collected or disclosed about you in the past 12 months, the sources of such information, the business or commercial purposes for collecting or selling it, and the categories of third parties with whom we shared Personal Information.
• The Right to Access: You have the right to request access to and/or a copy of certain Personal Information we have held about you during the past 12 months.
• The Right to Correct: You have the right to request that we correct inaccurate Personal Information about you.
• The Right to Delete: You have the right to request that we delete Personal Information you provided to us.
• The Right to Limit the Use and Disclosure of Sensitive Personal Information (SPI): Touchs Mail de-identifies users’ email content (which is considered SPI under the CCPA) related to commercial activities so it no longer identifies you. You may opt out of this use of your information by following these instructions: (1) Open the Touchs Mail app; (2) Go to the "Settings" page, tap "Manage Privacy"; (3) Tap "Opt-out of Data Sharing" to stop sharing data.
• The Right of Non-Discrimination: You have the right to not be discriminated against for exercising any of your rights.

Certain information and business practices may be exempt from these rights. For example, we may need certain types of information to provide our services to you or comply with legal obligations. If you request to delete certain information, we may refuse the request for these reasons or grant it on the condition that you may no longer be able to access or use our services.

You may also have the right to receive information about financial incentives we offer to you (if any).

4. Verification of Your Identity

Before we fulfill any request, you may be required to verify your identity, which may include providing your name, email address, mailing address, and/or phone number, depending on the nature of the request and the information we hold. If you have an online account with us, we may also require you to log into your account as part of the verification process. If you are a California resident, you may designate an authorized agent to make a request on your behalf, provided that the agent has written authorization from you. You may still be required to verify your identity and confirm the agent’s authority directly with us.

5.California "Shine the Light" Disclosure

Under the California "Shine the Light" law, California residents have the right to opt out of sharing certain categories of Personal Information with third parties for their direct marketing purposes. We do not currently share your personal information with third parties for their own direct marketing purposes.
